Obama’s jobs policy includes anti-worker H-1B visas

It was on March 31 that Vice President Joe Biden had the following exchange with a Davenport, Iowa TV station in a series of questions regarding H-1 visas taking American jobs:

Question: Are too many H1B visas given out each year?  Are too many highly skilled jobs going to people outside the U.S.?

Biden’s answer: No H1b visa can be granted to an employee to come to a company unless they can prove there is no American to fill the job. What we have had is a real vacuum in the number of computer engineers and high tech personnel to work In particularly Silicon Valley. That where most of those H1b visas are going. That why we have made it so attractive, and I don’t understand why Republicans have opposed it.

Either Vice President Biden has no clue of what he is talking about, or he is simply being untruthful as he promotes his administration’s talking points to campaign contributors.

Consider these three contradictions:

1.  No H1b visa can be granted to an employee to come to a company unless they can prove there is no American to fill the job.

2.  There is no data to show a “real vacuum” in tech workers.

3.  Most of the H-1B visa to to workers outside Silicon Vally.  In 2008, only 16% of H-1B workers went to California.

According to an article by Phyllis Schlafly in the April 6, 2012, e-mail directive of the Tennessee Eagle Forum, according to the U.S. Census Bureau, counting only U.S.-born individuals there are 101,000 with an engineering degree who are unemployed, another 244,000 who are not working or not looking for work and therefore not counted in unemployment statistics, and an additional 1.47 million who have an engineering degree but are not working as an engineer.

“Created in 1990, the H-1B program was designed for employers to import foreign H-1B workers to fill various high-tech jobs only when Americans could not be found.  The law was supposed to make it illegal for an employer to replace an American with am H-1B worker  Big corporation lobbyists, however, have succeeded in fuzzing up the law so there is now no effective law to prevent employers from firing American jobholders and replacing them with H-1B aliens.”

There is no mystery as to why big companies prefer H-1B workers to American workers:  1) They can pay them significantly less than Americans, 2) never have to give them a raise, 3) and have the power to deport them, ensuring that H-1B workers don’t dare to complain about working conditions or unpaid long hours.

This shady process has even introduced a new acronym into the English language, DYOG:  Dig Your Own Grave”, which results when H-1B workers are imported for entry-level jobs and then trained by experienced U.S. workers, whereupon the experienced U.S. workers are laid off.

A good example given in Phyliss Schlafly’s article of the DYOG practice involved a lawsuit filed against Molina Healthcare Inc. which handles Medicaid and Medicare paperwork for the government and Cognizant Technology Solutions Corp, and which imports workers from India.  One day after the Department of Labor approved Molina’s application for 50 H-1B workers, Molina fired approximately 40 competent U.S. programmers, managers and analysts, hiring 40 H-1B replacements.

Also reported by Schlafly is how President Obama has exacerbated the situation by proposing new rules to attract and retain highly skilled immigrant workers by expanding eligibility for foreign students to remain in the U.S. eliminating protections for U.S. workers, allowing employers to pay lower wages to alien workers, and by further giving work authorizations to spouses of H-1B workers thereby increasing competition for Americans looking for all kinds of jobs.

According to Phyliss Schlafly:

“Obama has made expanding H-1Bs a feature of his reelection campaign, trying to broaden the program that already allows the importations of 65,000 H-1B visa aliens annually.  Some people are even pushing the ridiculous notion of stapling a green card to college diplomas, so that foreigners would automatically be allowed to stay and work in our country.

Will that include the 57,000 Chinese undergraduates now in U.S. universities, most of whom were admitted on the basis of fake transcripts and recommendation letters, and are then awarded college degrees for which they did not qualify?” Schlafly calls the before described practice a racket that should be cleaned up.   http://townhall.com/columnists/phyllisschlafly/2012/03/20/h1b_visas…

Consider the most recent U.S. job market figures for March of this year.  Only 120,000 jobs were added, down from more than 200,000 in each of the previous three months. The unemployment rate fell to 8.2 %, the lowest since January 299l, but the rate dropped because fewer people searched for jobs.  Those no longer seeking work are not counted as unemployed.  http://www.timesunion.com/business/article/US-hiring-slows-amid-un...

Surely President Obama is worried about unemployment, for unemployment figures above 8% in November do not bode well for his re-election.

With this mind, why is President Obama expanding the via program rather than hitting the brakes?

The answer might lie in an exchange noted between President Obama and a woman back on Monday, January 30, whose husband was an unemployed semiconductor engineer. And why might President Obama be taking the word of the employers who are using H-1B workers which results in driving down wages and putting Americans out of out of work?

Consider one of America’s biggest tech firms, Microsoft.  In 2009 Microsoft laid off 5,800 workers, yet it continued to import H-1B workers, ranking fifth in FY-8 and moving up to second in FY09 on the top as H-1B employers.  Microsoft also extensively contracts with leading offshore offshore outsourcing firms like Infosys and Satyam.  Bth supply on-site personnel through guest worker visas, David Sirota in his article, “We have no shortage of skilled engineers,” suggests that President Obama’s expressed disbelief stems form fear of alienating his campaign donors in the high-tech industry.

Obvious is that hi-tech donors have a vested financial interest in answering Obama’s fund raising calls as a show of support for keeping the status quo, with a hands off approach to any proposed pro-worker reforms in programs like the H-1B visa.

H-1B visas are also being issued in the teaching profession.  Large numbers of teachers throughout this nation are being imported from other countries to teach non-English speaking student, mostly of Hispanic origin.

I was not surprised about the Waukegan Public Schools just north of my hometown in Lake Bluff, where there is a heavy influx of undocumented immigrants.

The American workers has become the victim of what amounts to a high-tech lucrative, executive scam. The Obama administration is counting on the ignorance of the American people in learning about the visa H-1B scam, while President Obama goes around the country telling the American people how things are getting better and how he needs a second term to fix all the massive problems he inherited from President George W. Bush in 2008.
